Written contracts are required for all work exceeding $2,000. Contracts will specify payment terms, scope of work, and your rights regarding liens and dispute resolution.<\/p><h2>7. Intellectual Property<\/h2><p>All website content, branding, photos, logos, and other materials are owned or licensed by BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory and are protected by applicable intellectual property laws. Billing, Deposits, and Payments<\/h2><h3>12.1 Deposits<\/h3><p>Deposits are <strong>due upon receipt<\/strong> of the deposit invoice. Installation dates and material orders are not secured, and no work is scheduled, until the deposit is paid in full. All deposits are <strong>non-refundable<\/strong> once paid. Deposits secure your installation date and cover initial materials procurement, scheduling, and design costs.<\/p><h3>12.2 Invoice Payment Terms<\/h3><p>General invoices are <strong>Net 30 from the invoice date<\/strong> unless other terms have been agreed to in writing. Final invoices are issued upon completion of installation or at milestones specified in your service agreement.<\/p><h3>12.3 Automatic Billing of Card on File<\/h3><p>By providing a credit card, debit card, or ACH payment method to BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory \u2014 whether through our website, a signed agreement, a deposit transaction, or any other channel \u2014 <strong>you authorize us to automatically charge that payment method on file for any invoice issued to your account when payment becomes due<\/strong>, including:<\/p><ul><li>Deposit invoices, on the date of issuance<\/li><li>Final invoices, on the Net 30 due date<\/li><li>Recurring service, maintenance, or subscription invoices, on each billing cycle<\/li><li>Approved change-order or additional-work invoices, on their stated due date<\/li><\/ul><p>You may request alternative payment terms (such as check, wire, ACH-on-demand, or a different due date) <strong>in writing<\/strong> before work begins or before the invoice becomes due. If alternative terms have been agreed to in writing, those terms supersede automatic card billing for that specific invoice. Otherwise, the card on file will be charged automatically.<\/p><p>You agree to keep the payment method on file current. If a charge is declined, you remain responsible for the invoice amount, any late fees under Section 12.4, and any fees imposed by your card issuer or bank.<\/p><p>To dispute a specific automatic charge, contact us in writing within 7 days at team@email.christmaslightsfactory.com.<\/p><h3>12.4 Late Payments and Service Charges<\/h3><p>Late payments may incur a service charge of <strong>1.5% per month (18% APR)<\/strong> or the maximum allowed by law, whichever is less, with a <strong>$50 minimum<\/strong>, plus all costs of collection including reasonable attorney fees, lien preparation and filing fees, and court costs.<\/p><h3>12.5 Returns and Restocking<\/h3><p>A <strong>15% restocking fee<\/strong> applies to all returned products, whether custom-ordered or from standard inventory. This fee covers handling, inspection, repackaging, and inventory management costs. Custom-ordered materials are non-refundable and non-returnable under any circumstances.<\/p><h3>12.6 Construction Lien Rights<\/h3><p><strong>BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory retains the right to file a construction lien against your property for any unpaid invoice<\/strong>, in accordance with Oregon&#8217;s Construction Lien Law (ORS Chapter 87). This right applies whether or not a payment method is on file and whether or not automatic billing has been attempted. See Sections 20 and 21 for the full Notice of Right to a Lien and collection terms.<\/p><h2>13. Cancellations and Refunds<\/h2><p><strong>For services involving custom materials:<\/strong><\/p><ul><li>Cancellations must be made at least 30 days before scheduled installation<\/li><li>This extended notice period is required due to the lead time for ordering and manufacturing custom products<\/li><li>Cancellations made less than 30 days before installation will forfeit the entire deposit, and the client remains responsible for all custom materials ordered<\/li><\/ul><p><strong>For standard installations:<\/strong><\/p><ul><li>Service cancellations must be made at least 72 hours before scheduled installation<\/li><li>Cancellations made less than 72 hours before installation will forfeit the entire deposit<\/li><\/ul><p>For cancellations due to weather or acts of God, BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory will reschedule at no additional charge. Custom-ordered materials are non-refundable and non-returnable under any circumstances. Standard inventory items may be returned within 14 days subject to the 15% restocking fee outlined in Section 12.5.<\/p><h2>14. Installation and Service Terms<\/h2><p>Installation dates are subject to weather conditions and may be rescheduled at BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory&#8217;s discretion for safety reasons. Client must ensure clear access to installation areas and inform BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory of any hazards, restrictions, or special requirements.<\/p><p>Any additional work beyond the original scope will be quoted separately and requires written approval. Removal services, if included, will be scheduled within the timeframe specified in your service agreement, typically January through February, weather permitting. Orders requiring custom materials may have extended lead times of 2\u20134 weeks from deposit date.<\/p><h2>15. Damage and Liability<\/h2><p>BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory maintains comprehensive insurance but is not responsible for pre-existing damage to rooflines, gutters, or property. Client agrees to inspect and approve installation within 48 hours of completion. Any concerns must be reported immediately.<\/p><p>BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory is not liable for damage caused by extreme weather, acts of God, or third-party interference after installation is complete. Clients assume responsibility for electrical costs and ensuring adequate power supply.<\/p><h2>16. Warranty<\/h2><p>BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory provides a seasonal warranty on all installations, covering equipment failure and workmanship issues through the removal date specified in your agreement. This warranty does not cover damage from weather events, vandalism, or client modifications.<\/p><p>Replacement of burned-out bulbs during the season is subject to service call fees unless covered by a maintenance agreement. All warranty claims must be submitted in writing to team@email.christmaslightsfactory.com.<\/p><h2>17. Custom Materials Acknowledgment<\/h2><p>Client acknowledges that custom materials are specifically ordered or manufactured for their project and cannot be resold or repurposed. By approving designs requiring custom materials, client accepts the 30-day cancellation requirement and understands they are financially responsible for all custom products ordered on their behalf, regardless of installation status.<\/p><h2>18. Severability<\/h2><p>If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.<\/p><h2>19. Oregon Construction Contractors Board (CCB) License Disclosure<\/h2><p>BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory is a licensed contractor in the State of Oregon.<\/p><p><strong>CCB License Number: 257964<\/strong><\/p><p>The Construction Contractors Board has jurisdiction for resolution of certain disputes between contractors and consumers. NOTICE OF RIGHT TO A LIEN \u2013 REQUIRED BY OREGON LAW<\/h2><p><strong>NOTICE TO OWNER: INFORMATION ABOUT CONSTRUCTION LIENS<\/strong><\/p><p>Under Oregon&#8217;s construction lien law, those who work on your property or provide labor, equipment, or materials and are not paid have a right to enforce their claim for payment against your property. This claim is known as a construction lien.<\/p><p>If your contractor or a subcontractor fails to pay subcontractors, suppliers, or laborers or neglects to make other legally required payments, the people who are owed money may look to your property for payment, even if you have paid your contractor in full.<\/p><p>To protect yourself, you should:<\/p><ul><li>Require your contractor to provide lien waivers from all subcontractors and material suppliers<\/li><li>Pay with checks made jointly payable to the contractor and subcontractors\/suppliers<\/li><li>Verify that your contractor has paid all bills before making final payment<\/li><\/ul><p><strong>BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory RIGHT TO LIEN:<\/strong> By engaging our services, you acknowledge that BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory maintains the right to file a construction lien against your property under ORS Chapter 87 if payment is not received according to the terms of our agreement. This lien may be filed up to 75 days after completion of residential work or 90 days for commercial work.<\/p><h2>21. Payment Terms and Collection Rights<\/h2><p><strong>Payment Due:<\/strong> Deposits are due upon receipt. General invoices are Net 30 from the invoice date unless other terms have been agreed to in writing. Cards on file will be billed automatically as described in Section 12.3.<\/p><p><strong>Late Payment Charges:<\/strong> Accounts not paid by the due date will incur:<\/p><ul><li>Late fee of 1.5% per month (18% APR) or $50 minimum, whichever is greater<\/li><li>All costs of collection including reasonable attorney fees<\/li><li>Lien preparation and filing fees if applicable<\/li><\/ul><p><strong>Lien Rights:<\/strong> If payment is not received within 30 days of the due date, BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory may:<\/p><ul><li>Send a Notice of Intent to Lien via certified mail<\/li><li>File a construction lien against your property<\/li><li>Pursue legal action to foreclose on the lien<\/li><li>Report delinquent accounts to credit bureaus<\/li><\/ul><p><strong>Once a lien is filed:<\/strong><\/p><ul><li>It will appear on your property title<\/li><li>Interest accrues at 9% per annum (Oregon statutory rate)<\/li><li>You will be responsible for all legal fees and costs<\/li><li>The lien must be satisfied before selling or refinancing your property<\/li><\/ul><h2>22. Pre-Installation Notifications<\/h2><p><strong>IMPORTANT PROPERTY OWNER PROTECTIONS:<\/strong><\/p><p>Before work begins, BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory will:<\/p><ul><li>Verify property ownership or obtain owner authorization<\/li><li>Provide written estimate of all costs<\/li><li>Disclose any subcontractors who will perform work<\/li><li>Provide our CCB license number on all contracts and invoices<\/li><\/ul><p><strong>Your Rights as a Property Owner:<\/strong><\/p><ul><li>You may require a performance bond<\/li><li>You have the right to receive a list of all subcontractors<\/li><li>You may request lien waivers as work progresses<\/li><li>You can file a complaint with the CCB if disputes arise<\/li><\/ul><h2>23. Dispute Resolution and Claims<\/h2><p><strong>CCB Dispute Resolution:<\/strong> For amounts up to $75,000, disputes may be resolved through the CCB&#8217;s dispute resolution process. This is often faster and less expensive than court proceedings.<\/p><p><strong>Claims Against Bond:<\/strong> BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory maintains a surety bond as required by the CCB. Claims against this bond must be filed within the timeframes specified by Oregon law.<\/p><p><strong>Warranty Claims:<\/strong> All warranty claims must be submitted in writing within the warranty period. The CCB requires contractors to honor written warranties.<\/p><h2>24. Required Consumer Notice<\/h2><p><strong>NOTICE:<\/strong> You may be protected by a bond filed with the Construction Contractors Board. If you suffer damages as a result of BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory&#8217;s breach of contract, you may be able to file a claim against the bond. Contact the CCB for more information.<\/p><p><strong>Consumer Protection Notice:<\/strong> Oregon law requires contractors to be licensed and bonded. You should verify that BrightWrx Holiday Lighting \u2013 Formerly Christmas Lights Factory is properly licensed by calling the CCB at 503-378-4621 or visiting <a href=\"https:\/\/www.oregon.gov\/ccb\" rel=\"nofollow noopener\" target=\"_blank\">www.oregon.gov\/ccb<\/a>.<\/p><h2>25.
