12. Billing, Deposits, and Payments

12.1 Deposits

Deposits are due according to the applicable deposit invoice, proposal, or service agreement.

Installation dates and material orders may not be secured, and work may not be scheduled, until the required deposit has been paid.

Unless otherwise stated in writing, deposits may become non-refundable once:

Custom materials have been ordered.

Design work has begun.

Labor or scheduling resources have been committed.

Installation preparation has started.

Deposits may be applied toward materials procurement, scheduling, design, and other project preparation costs.

12.2 Invoice Payment Terms

General invoices are Net 30 from the invoice date unless other payment terms have been agreed to in writing.

Final invoices may be issued upon completion of installation or at milestones specified in the applicable service agreement.

Customers are responsible for reviewing invoices promptly and reporting billing questions in a timely manner.

12.3 Automatic Billing of Card or Payment Method on File

By providing a credit card, debit card, ACH account, or other payment method and authorizing BrightWrx Western Kentucky to keep that payment method on file, you authorize BrightWrx Western Kentucky to charge that payment method for amounts that become due under your approved proposal, invoice, or service agreement.

This may include:

Deposit invoices

Final invoices

Recurring service, maintenance, or subscription invoices

Approved change-order invoices

Approved additional-work invoices

Other authorized charges stated in an applicable agreement

You may request alternative payment terms, such as check, wire, ACH-on-demand, or another agreed method, before the applicable invoice becomes due.

If alternative terms have been agreed to in writing, those terms will supersede automatic billing for that specific invoice.

You agree to keep your payment method information current.

If a charge is declined, you remain responsible for the outstanding invoice amount and any fees permitted under these Terms and applicable law.

To dispute a specific automatic charge, contact us in writing at brian@precisionprowash.com.

12.4 Late Payments and Service Charges

Late payments may incur a service charge of up to 1.5% per month, or the maximum amount permitted by applicable law, whichever is less.

Where permitted by law, customers may also be responsible for reasonable costs incurred in collecting overdue balances, including collection expenses and legal costs.

12.5 Returns and Restocking

Standard products approved for return may be subject to a 15% restocking fee.

Returned items must be in acceptable condition and may be inspected before a refund or credit is issued.

Custom-manufactured, custom-cut, specially ordered, personalized, or otherwise project-specific materials are generally non-refundable and non-returnable once ordered.

12.6 Collection and Lien Rights

BrightWrx Western Kentucky reserves all payment, collection, and lien rights that may be legally available for qualifying work under applicable Kentucky law.

Any lien or collection remedy will be pursued only in accordance with applicable legal requirements.

Nothing in these Terms should be interpreted as creating a lien right where one does not otherwise exist under applicable law.

13. Cancellations and Refunds

For services involving custom materials:

Customers should provide cancellation notice at least 30 days before the scheduled installation whenever possible.

Deposits may be forfeited after custom materials have been ordered.

Customers may remain responsible for approved custom materials specifically ordered or manufactured for their project.

Custom materials may be non-refundable and non-returnable.

For standard installations:

Service cancellations should be made at least 72 hours before scheduled installation.

Late cancellations may result in forfeiture of the deposit or other charges where labor, materials, scheduling resources, or other costs have already been committed.

For cancellations or delays caused by unsafe weather or circumstances outside our reasonable control, BrightWrx Western Kentucky will make reasonable efforts to reschedule the work.

Weather-related rescheduling by BrightWrx Western Kentucky does not normally constitute cancellation of the customer’s project.

14. Installation and Service Terms

Installation dates are subject to weather conditions, crew availability, material availability, safety conditions, and other operational requirements.

BrightWrx Western Kentucky may reschedule work when necessary for safety or circumstances outside our reasonable control.

Hazards
Access restrictions
Locked gates

Any additional work beyond the original project scope may be quoted separately and may require written approval.

Orders requiring custom materials may require additional lead time.

Custom materials may not be suitable for resale or reuse on another property.

By approving a design or project requiring custom materials, the customer acknowledges that those materials may become non-refundable once ordered and that the customer may remain financially responsible for approved custom products even if the project is later cancelled.

18. Severability

If any provision of these Terms is found to be unenforceable, illegal, or invalid, that provision shall be limited, modified, or eliminated to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

Written payment demands

Collection services

Verify property ownership or obtain property-owner authorization.

Provide a written estimate or proposal.

Identify the agreed scope of work.
